PRIVACY POLICY
The company Endorphina Ltd., company incorporated in Malta, ID C77672, with its
registered office at:
27/28, Triq Torri Wejter, Birkirkara, BKR730, Malta, organises Competition described by the Terms and in
this connection, it processes certain personal data of Participants of such Competition and therefore
acts as a data controller towards such personal data.
By ticking the relevant box while submitting Information, you give the company Endorphina Ltd.
your
consent to the below described processing of your personal data in the meaning of the art. 6 of
Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of
natural persons with regard to the processing of personal data and on the free movement of such data
(General Data Protection Regulation).
1. Definitions
1.1. “identification data“ means your name and surname.
1.2. “contact data“ means your e-mail address and phone number.
1.3. “personal data“ means any piece of data or information that relates to a certain
concrete natural person which is in connection with this information identified or which can be directly
or indirectly identified on the basis of such information.
1.4. “Controller“ means the company Endorphina Ltd. company incorporated in Malta, ID
C77672, with its registered office at: 27/28, Triq Torri Wejter, Birkirkara, BKR730, Malta.
1.5. “Competition“ means the above mentioned Competition “Dinner in the Sky” organised
by the Controller for which you are submitting the questionnaire that allows you to participate in this
Competition and possible on the Dinner as is this term specified in the Terms.
1.6. “processing“ means any operation or set of operations which is performed on
personal data or on sets of personal data, whether or not by automated means, such as collection,
recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use,
disclosure by transmission, dissemination or otherwise making available, alignment or combination,
restriction, erasure or destruction.
1.7. “Terms” means terms & conditions agreed by you in column above that regulate the
legal relationship between you and Controller and lays down the conditions of the Competition.
2. Scope of processing
2.1. The Controller is authorised to process your personal data listed below:
a) your identification data;
b) your contact data;
c) your physical appearance captured in photographs or audiovisual recordings which will be made by the
Controller or other authorised persons to document course of the Competition.
3. Purpose of processing
3.1. The Controller is authorised to process your identification data only for the below specified
purposes:
a) fulfilling obligations arising for the Controller out of the contract that has been concluded with
the Controller on the basis of an order by you to attend the Competition;
b) your identification for the purpose of verifying legitimacy of your attendance in the
Competition;
c) fulfilling obligations arising for the Controller as the organiser of the Competition out of any
relevant legal acts and regulations.
3.2. The Controller is authorised to process your contact data for the below specified purposes:
a) to contact you regarding the Competition and possible win of the Prize;
b) to be able to contact you in case of any changes of time or venue of the Dinner;
c) to be able to inform you of any other relevant facts regarding the Competition which you should know;
d) to send you the Controller´s e-mail newsletter and other advertising materials for its products and
services.
3.3. The Controller is authorised to use photographs and audiovisual recordings which capture the course
of the Dinner and which capture your physical appearance only for marketing purposes (creation of
leaflets, advertising videos etc.), i.e. to promote events organised by the Controller or its other
products and services. In this connection you acknowledge and agree to the fact that you have no right
for any reward or compensation for this use of your physical appearance.
4. Duration of processing
4.1. The Controller shall process your personal data until one year after the date of the Dinner.
5. Your rights
5.1. In connection with the processing of your personal data you have the following rights:
a) the right of access to your personal data;
b) the right to rectification of your personal data in case they are inaccurate;
c) the right to withdraw this consent to the processing of your personal data;
d) the right to be forgotten, i.e. the right to have the Controller erase your personal
data if any of the following cases arises:
• your personal data are no longer necessary for the above specified purposes;
• you withdraw this consent to processing of your personal data;
• your personal data are being processed unlawfully by the Controller;
• your personal data must be erased in order to fulfil the Controller´s legal obligation;
e) the right to restriction of the processing of your personal data if any of the
following cases arises:
• you contest the accuracy of the processed personal data;
• the processing of your personal data is unlawful;
• the Controller no longer needs your personal data for the given purposes;
f) the right to data portability, i.e. the right to receive your personal data which
are processed by the Controller with the use of technical means (stores in an electronic register etc.)
in a structured, machine-readable format.
Please note that giving this consent is contractually required by the Controller and that you are not
obligated to give this consent.
By ticking the relevant box while making submission of the questionnaire, you express your
consent to the above described processing of your personal data.
TERMS AND CONDITIONS OF THE COMPETITION
These Terms and Conditions (“Terms”) regulate legal relationship between physical entities
(“Participants”) that will be submitting requested information (“Information”) in order enter the
competition (“Competition”) to win the prize provided by the organiser Endorphina Ltd.
(“Endorphina”)
1. Terms of the Contest
1.1. The Competition provides possibility to win the prize - dinner in the sky for ONE person (“Dinner”) together with 21 people from Endorphina and/or Endorphina’s business partners at the same table (“Prize”).
1.2. In order the participate in the Competition all Participants must personally fill out and submit a questionnaire stated on website www.endorphina.com/igb-live and also must attend the iGB Live! show, which shall take place between 16th to 19th July in RAI Amsterdam, Netherlands.
1.3. The Prize shall contain food and drinks according to the offer of the Dinner. Endorphina shall not provide any other compensations (travelling fare or similar).
1.4. The Dinner shall take place in Amsterdam, Netherlands on 18th of July 2019. The exact time and location shall be specified later but it is estimated on 18:30.
1.5. Winner of the Prize will be selected randomly on 16th July and will be immediately contacted by e-mail and by phone stated in the Information. In case on unavailability of the Winner Endorphina will proceed and randomly select another winner by using the same procedure until the Endorphina manages to successfully contact the winner which is able to attend the Dinner.
2. Limitation of the liability and declaration of the Participant
2.1. the Participant acknowledges that the Dinner shall take place in 50 meters above the ground when the whole venue shall be lifted by the crane. Due to its specific location, the Participant declares that:
- he or she is in a good health condition and above mentioned arrangement will not bring any expected or unexpected health issues, and
- he or she does not suffer from any height anxiety or any similar issues and therefore he or she will be able to sustain on his place at the Dinner for the whole duration of the Dinner. The approximate duration of the Dinner at this altitude will be 60 minutes.
2.2. In no event will the Endorphina be liable for incidental, indirect, special or consequential damages, or any other damages whatsoever resulting from the breach of the declaration of the Participant mentioned in article 2.1. herewith.
2.3. The Participant acknowledges that the Dinner could be canceled due to unforeseen circumstances or extreme weather conditions.
2.4. The Endorphina is not liable to the Participant for any claim related to any Participant’s expectation or experience of the Dinner or Prize whatsoever.
2.5. All disputes and all matters which may arise out of or in connection with the execution of the present Terms are to be resolved whenever possible by means of negotiations between the Endorphina and the Participant. In the event of failure to settle the disputes and all matters by means of negotiations they must be submitted for settlement in in court at the location of the Endorphina.
2.6. The Endorphina as a provider of this contest is entitled to change this Terms or partly or completely cancel the Competition at any time.
